Jobseeker is provided to you by the company Resumedia BV, which is registered in the Netherlands under the number 66341817 assigned to it by the Chamber of Commerce. The utilization of Jobseeker is subject to the following terms and conditions: You acknowledge and accept this by continuing to use Jobseeker.

Any deviations from or additions to these terms of use will only become legally binding once Jobseeker has given its written consent to them.

Article 1 Use of Jobseeker

1.1 You will be charged a fee to use Jobseeker's capabilities to generate, modify, download, and send application letters and CVs. In addition, you will be able to view relevant job openings and have those openings sent to you if your CV is a match for them.

1.2 After you have created a CV, an account will be created for you automatically. You will be able to continue using Jobseeker once your registration has been finished, and Jobseeker will have activated your account. After this, you will be able to log in directly to your account and use Jobseeker.

1.3 By using a username and password, you can prevent unauthorized users from accessing your account. This security measure is required. In particular, the password needs to be guarded against disclosure in any way. Jobseeker might assume that everything that happens with your account after they log in with their username and password is done under their direction and supervision if they see that you have control over it. You are responsible for all of these actions as a result, unless you have informed Jobseeker that someone else is aware of your password.

1.4 Your private information will be processed if you use Jobseeker. For further information, please refer to the privacy statement provided by Resumedia BV.

Article 2 The ground rules

2.1 Personal accounts are non-transferable and cannot be shared.

2.2 It is against the rules to use Jobseeker for activities that run counter to applicable laws and regulations at the national or international level. This includes, but is not limited to, the storage or distribution of information that is libelous, defamatory, or racist via Jobseeker, as well as the sending of unsolicited messages to other users.

2.3 Jobseeker reserves the right to take corrective action in the event that it identifies a violation of the aforementioned terms on its own or if it receives a complaint in this regard. In the event that the provisions of 2 are breached, the following will occur: 1. The account will in any event be terminated and removed from use.

2.4 If Jobseeker believes that there will be a disruption, damage, or other danger to the functioning of the computer systems or the network of Jobseeker or third parties and/or of the services provided via the internet, particularly as a result of an excessive amount of e-mail or other data being sent, then Jobseeker reserves the right to terminate the account of the Jobseeker. Leakage of personal data or activities of viruses, Trojan horses, or other software in a similar vein, Jobseeker has the right to take any and all measures that it considers to be reasonably necessary to avert or prevent this danger.

2.5 A job seeker has the absolute right to report any crimes that have been proven to have been committed at any time.

2.6 Jobseeker is entitled to seek compensation from you for any losses incurred as a result of violating these standards of behavior. You agree to defend and hold Jobseeker harmless against any claims brought by third parties in connection with information that you post.

2.7 You are solely responsible for all of the arrangements that you make online with Jobseeker, including but not limited to the generation of your CV, the preparation of a cover letter, and the transmission of both.

Article 3 Provisioning and upkeep are also included.

3.1 Jobseeker makes every effort, but Jobseeker cannot guarantee that they will be available at all times. Jobseeker makes every effort.

3.2 Jobseeker is constantly working to maintain Jobseeker. Any time is fine for maintenance to be performed, even if it reduces the amount of time the system is available to users. When possible, maintenance will be communicated in advance to users.

3.3 Jobseeker is subject to implementing new features and modifying existing ones at any time. Your comments and ideas will be taken into consideration, but in the end, Jobseeker will decide on its own which modifications it will and will not make.

Article 4 Ownership of ideas and creations

4.1 Jobseeker, the CV templates, the application letter examples, the associated software, and each and every piece of information and image that can be found on the website are all the intellectual property of Jobseeker or one of its licensors. These may not be copied or used in any way without the specific and written permission of Jobseeker, with the exception of situations in which such activity is expressly permitted by law.

4.2 The information that you publish or store through Jobseeker, such as the content of your curriculum vitae or a photograph of your passport, is and will continue to be your property (or the property of your suppliers). Jobseeker is granted a restricted license to use this information for their own purposes.

4.3 You have the ability to revoke this right of use at any time by deleting the pertinent information and/or by terminating the agreement.

4.4 You have complete control over how, when, and whether you modify information that you publish or save using Jobseeker.

4.5 If you send information to Jobseeker, such as feedback about an error or a suggestion for improvement, you grant it an unlimited and perpetual right to use this information for Jobseeker. For example, if you provide feedback about an error or a suggestion for improvement. Information that you have expressly marked as confidential is exempt from this rule.

4.6 Jobseeker will not take cognizance of private data (such as communication between job seekers and employers) that you store and/or distribute via Jobseeker, unless this is necessary for a good service or Jobseeker is obliged to do so by virtue of a legal provision or court order. 4.7 During the time that your subscription is active, you will have the ability to use Jobseeker as well as any documents that you have created with its assistance, such as a resume or cover letter. Once your subscription has been terminated, you will no longer have the right to use the cover letters and/or the layout of the CV(s) that you have generated. This includes both the layout and the content of the CV(s). After the purchase of Jobseeker's rights resting on these documents, only then are you permitted to use these documents.

Article 5 Reimbursements for Jobseeker

5.1 You will be required to pay in order to download the CV that you have created.

5.2 When using Jobseeker for the first time, you will need to purchase a subscription. The monthly costs associated with the subscription After 14 days' notice in advance, a monthly deduction will be made for this fee.

5.3 On the Jobseeker website, you can get up-to-date information regarding the costs of subscriptions as well as the fees for downloading the CV that you have created.

Article 6 Legal standing to dissolve

6.1 Because the CV is delivered digitally immediately, at your explicit request, and after you have waived your right to dissolution, the statutory right to dissolution is forfeited. This occurs when the right to dissolution is waived.

6.2 Within the first 14 days after the signing of this agreement, you have the option to terminate the agreement pertaining to the subscription. Your payments that were made in relation to the subscription will be returned to you without delay, and at the very latest within 14 days after the subscription has been terminated. If during the cooling-off period no payment was made in exchange for the subscription, you will not be eligible for a refund when the subscription is terminated.

Article 7 The terms of payment

7.1 Payment can be made through iDEAL, direct debit, credit card, or PayPal, or in accordance with the instructions provided on the website for making payments. Jobseeker's account will be made active as soon as the payment has been processed and received.

7.2 The amount that is owed for the subscription will be deducted from the chosen method of payment on a monthly basis.

7.3 Jobseeker will send you a payment reminder in the event that your payment is late. You will have 14 days to make the payment after receiving the reminder. You are considered to be legally in default of your payment obligation as of the date and time specified in this reminder if you do not meet your payment obligation after receiving this notice of default. From that point forward, Jobseeker has the legal right to limit the services it provides, such as by restricting users' access to the Jobseeker website.

7.4 If Jobseeker is unable to collect the amount that is owed and/or if you do not pay on time, you are obligated to pay full compensation for the extrajudicial costs in addition to the amount that is owed and the interest that has accrued on it. This is in addition to the amount that is owed and the interest that has accrued.

Article 8 The length of the subscription and how it can be terminated

8.1 According to the terms outlined in article 1 of these terms and conditions, the subscription will begin as soon as your account has been successfully created.

8.2 If you are a consumer and enter into the subscription, you will always have access to your account in order to terminate the subscription at any time. In any event, the subscription needs to be canceled before the beginning of the new billing cycle in order to avoid being automatically renewed.

Article 9 Liability

9.1 The following liability provisions are applicable to the use of Jobseeker, provided that no other legal provision directly contradicts this principle:

9.2 Jobseeker's liability is limited to the total amount that you paid for the three months prior to the time that the damaging event occurred, with the exception of situations involving intent or gross negligence.

9.3 Jobseeker is not responsible in any way, shape, or form for any indirect damages, consequential damages, lost profits, lost jobs, or lost savings, nor for any damages caused by business interruption.

9.4 In the event of a case of force majeure, Jobseeker is under no obligation to make up for any losses suffered by you as a direct result of the event. Failures or malfunctions of the internet, the telecommunications infrastructure, power failures, internal disturbances, mobilization, war, transportation disruptions, strikes, lockouts, business disruptions, stagnation in supply, fires, and floods are all examples of events that qualify as "force majeure" in this context.

Article 10 Alterations to prices as well as conditions

10.1 Jobseeker is permitted, to the extent permitted by law, to make modifications to both these terms and conditions as well as the prices.

10.2 Jobseeker will make an announcement on the Jobseeker website at least thirty days before any changes or additions go into effect so that you can make a note of them and prepare accordingly.

10.3 You have the option to back out of the agreement up until the day it goes into effect if you do not want to comply with a modification or an addition. Utilization of Jobseeker after the date of implementation constitutes acceptance of the terms and conditions as they have been modified or expanded.

Article 11 Additional provisions

11.1 This agreement will be governed by Dutch law.

11.2 Insofar as mandatory law does not dictate otherwise, all disputes relating to Jobseeker will be submitted to the competent Dutch court for the district in which Jobseeker is established. This is the case regardless of whether or not the dispute involves a mandatory law.

11.3 If a provision in these terms of use states that a communication must be made "in writing," then the provision is considered to have been satisfied if the communication was made by e-mail or via the Jobseeker platform. provided that it can be demonstrated beyond a reasonable doubt that the message in question did, in fact, come from the purported sender and that the authenticity of the message has not been undermined in any way.

11.4 Jobseeker is permitted to transfer its rights and obligations under the agreement, in addition to the personal data that it processes, to a third party that takes over Jobseeker or the relevant business activity from it.
