Lack of a Tax File Number

Make an application for a TFN.

Residents of Australia are able to submit an application for a TFN at any age.

Who may submit an application?

Online applications for a Tax File Number (TFN) can be submitted by individuals with foreign passports, permanent migrants, and temporary visitors using the Individual Auto Registration (IAR) system.

The creation of a TFN doesn't cost anything.

You will need authorization from the Department of Home Affairs, in the form of a current visa, in order to work in Australia.

  • a piece of paper issued by the Registrar of Births, Deaths, and Marriages of a state or territory that acknowledges a change in gender (or sex).
  • a statement from a registered medical practitioner or a registered psychologist that identifies your preferred gender (sex) and indicates that the practitioner or psychologist has reviewed your case.

If you are going to use a statement from a registered medical practitioner or a registered psychologist, the statement needs to include the following information:

  • the letterhead of the physician or the psychologist, which includes their complete name and relevant contact information
  • a statement from the doctor or psychologist stating that they have examined your medical history or provided you with treatment.
  • your complete name as well as the gender (sex) that you wish to be identified as
  • the signature of a licensed medical professional or licensed psychologist
  • the registration number of the medical practitioner or psychologist from the Medical Board of Australia, the Psychology Board of Australia, or an equivalent overseas authority

You also have the option, within your ATO record, to record your gender or sexual orientation as indeterminate.

Even if you are unable to provide the required documentation in order to update the gender (sex) information associated with your record, we will still be able to assist you by removing any courtesy titles from your file, such as Mr., Mrs., Ms., or Miss.

By phone

Over the phone, we are unable to change your gender (sex) that has been recorded unless we have recorded it incorrectly based on an identity document that was provided during registration.

We are able to modify or remove your title even if you do not have the necessary documentation:

  • To contact us in Australia, dial 13 28 61 between 8 00am–6 00 o'clock, from Monday through Friday
  • If you are calling from outside Australia, dial +61 2 6216 1111 between 8 00am–5 00 pm Australian Eastern Standard Time (AEST) and ask to be transferred to the department that deals with "Personal tax enquiries."

Write to us and include all of the following information in your letter if you want to change your gender details by mail:

  • the name and address that we have on file for you, as we have it recorded
  • your new name, as well as your title

We are only able to pay refunds into bank accounts located in Australia. Online access is the most efficient method for keeping your details regarding financial institutions up to date. You will need a myGov account that is linked to the ATO in order to accomplish this.

It is required that the account be held by:

  • you under either your legal or business name, either on your own or in conjunction with others
  • your authorized tax preparer or BAS agent
  • a licensed attorney who will act on your behalf as trustee or executor

When you provide the details of your account, we require the following:

  • number assigned to a bank's state branch, abbreviated BSB and consisting of six digits
  • account number – the total number of digits in this number cannot exceed 9
  • title of the account

Make changes to the information about your financial institution online.

If you want to update the information about your financial institution online, make sure that the BSB and account number do not contain any spaces or hyphens.

When entering the account name, make sure to include spaces between each word as well as initials wherever they are required, such as JQ Citizen. Only the first 32 characters of the account name should be entered, even if it has more than 32 total. Leave out the account type, which could be something like a checking, savings, or mortgage offset account.

Obtaining certification for documents

In order to provide evidence in support of your applications, you are required to have copies of your identification documents notarized. An authorized certifier needs to verify that the copies are accurate representations of the original document before they can be used.

To certify your document:

  1. photocopy it, making sure that both the text and the photographs are legible and easily recognizable.
  2. Bring both the copy and the original to one of the authorized certifiers listed in the following table.

These certified copies can be mailed to the address provided. Please do not send us any of your original documents because there is a possibility that we will not be able to return them.

Even if you initial the changes, we are unable to accept a document that has been altered or corrected by you.

Licensed certifying bodies

The following individuals are qualified to attest that copies of your original identification documents are accurate and true:

  • Barrister
  • Solicitor
  • Medical Board of AustraliaExternal LinkA medical practitioner who is registered with the Medical Board of AustraliaExternal Link, either as a general practitioner or a specialist (pharmacists are not included in this category).
  • Judge
  • Office of the Justice of the Peace
  • Minister of religion (someone who is authorized to preside over wedding ceremonies).
  • Officer of the law
  • Officer of a bank, building society, or credit union who has worked there for at least five years
  • Officer of the sheriff
  • Only in Queensland can you become a Commissioner of Declarations.

Documents should never be witnessed by an approver certifier in the following situations:

  • It has the potential to create a conflict of interest, either real or perceived.
  • The documents are related to issues in which they have an actual or perceived personal or financial interest in either directly or indirectly.

A tax agent can't certify a document This is due to the fact that we are unable to confirm with absolute certainty that the agent does not have any potential conflicts of interest or commercial relationships with the entity that they are representing in tax matters.

You will require information from a certifier who is authorized.

An authorized certifier is required to vouch for the authenticity and accuracy of each copy of the original document by performing the following steps:

  • checking both the original document and the copies of the front and back of the document at the same time.
  • affixing a stamp, signing one's name, and making a note on the copy of the document that says something along the lines of "I have sighted the original document and certify this to be a true and correct copy of the original document sighted," if such a thing is available.
  • please provide the following information:
    • full name
    • number to call on the phone
    • qualification
    • number of registration (if it is applicable)
    • date of certification or registration

If the applicant hands you an original document that has more than one page, you have certain responsibilities as the certifier, which are as follows:

  • a trust
  • alternative organization
  • a payer who is only liable for GST or withholding tax

Why we are responsible for establishing your identity

In order to issue a Tax File Number (TFN), we have to first determine the identity of an entity and any associated parties.

It's possible that we'll check the particulars of an application for a foreign business with the appropriate authority in your country.

We reserve the right to accept alternative credentials in situations where an entity or its associates are unable to provide us with the identity documents that we require.

It's possible that we won't require any additional proof of identity documents from you if you provide us with proof of identity documents in support of another registration.

However, in order to register for an ABN, you will require additional proofs of identity documents.

We will accept notarized copies of your original documents as proof of identity. Documents written in languages other than English are required to have a written translation included with each copy. It is possible that we will not return certified copies of documents unless you expressly request that we do so.

Individual points of interest

Individuals and individual associates of entities that aren't considered to be Australian residents for tax purposes are required to provide us with two current proofs of identity documents.

A primary document from the following list needs to be selected as one of these documents.

Primary documents

Primary documents include:

  • Certificate of birth obtained abroad
  • Foreign passport
  • Certificate of birth issued in Australia
  • A passport from Australia

Secondary documents

The following are examples of secondary documents:

  • National photo identification card
  • Identification of a government from another country
  • Certificate of marriage issued in another country: if you use this document to verify your name change, you cannot then use it as a secondary document in the United States.
  • License to drive issued in another country: the address that appears on the license and the address that you provide on your application must be identical.

If you have recently changed your name, you are required to provide us with an additional document that verifies the change. For instance, a certificate of marriage, a change of name certificate, or a deed poll certificate

You are required to provide us with a document that demonstrates your preferred gender if the documents you use to prove your identity do not reflect your preferred gender. Documents such as an updated birth certificate or a statement from a licensed medical professional are two examples.

When an individual associate already possesses a TFN and you provide it on the application for a TFN, we do not require POI documents for that individual associate. It is not required by law for an individual to provide us with their TFN; however, providing us with this information will make the processing of your application go more quickly and smoothly.

POI for an organization or other non-individual entity

If you fit one of these categories, you must comply with different POI requirements:

  • multinational corporation
  • partnership
  • or some other type of organization
  • an organization that needs a TFN for withholding payer-only registration or GST-only registration.

Companies

In order for us to verify the legitimacy of an international business, the business in question must provide us with their Australian Registered Body Number (ARBN).

If the business does not already have an ARBN, you will need to provide us with a certificate of registration or incorporation (or something equivalent) from the appropriate government agency.

A signed statement to the effect is acceptable in the event that you are unable to provide us with a certificate of registration or incorporation. The statement needs to be signed by at least two directors of the company.

Because of the following, we require the following information:

If you include the TFN of a company associate who already possesses a TFN on the application for a TFN, we will not require proof of identity documents for that associate. There is no legal requirement for an associate to provide us with their TFN, as that information is not required by law. If you provide your TFN, we will be able to process your application more quickly and with less effort.

Partnerships

For the purpose of establishing the identity of a foreign partnership, we require proof of identity documents from at least one of the partners (in accordance with the type of entity that each partner represents).

For instance, a partnership consisting of three companies would be required to present the same proof of identification documents as a company.

We are able to accept certified copies of the original documents for the POI. Documents written in languages other than English are required to have a written translation of the document included with each copy of the document. It is possible that we will not return certified copies of documents unless you expressly request that we do so.

If you include the TFN of a company associate who already possesses a TFN on the application for a TFN, we will not require proof of identity documents for that associate. There is no legal requirement for an associate to provide us with their TFN, as that information is not required by law. If you provide your TFN, we will be able to process your application more quickly and with less effort.

Trusts

In order to establish the identity of a foreign trust, you will need proof of identity documents (POI) for all of the trustees (in accordance with the entity type of each trustee).

For instance, a private trustee would be required to provide us with the same proof of identity materials as an individual.

If an employee of the company already possesses a TFN and you include it on the application for a TFN, then we do not require proof of identity documents for that employee. There is no legal requirement for an associate to provide their TFN, as this is not required by the law. If you provide your TFN, we will be able to process your application more quickly and with less effort.

The remaining organizations

In order for us to verify the legitimacy of an international organization, we require that the organization provide us with their Australian Registered Body Number (ARBN).

If the organization does not have an ARBN, you are required to give us the following information:

Withholding registrations that contain only payer numbers

We require the following in order to establish the identity of an entity for the registration of a withholding payer number (WPN) only:

  • documents that demonstrate the entity's registration with a corporate, market, or financial regulator equivalent in the country of the entity's origin
  • a letter from the revenue authority of a taxing system that is comparable to the one being used, stating that the entity is present in their records and that it operates a business.

You do not require proof of identity documents in order to establish the identity of the company's directors, public officers, or associates.
