Breaking the Law: Importing Cigarettes to Australia - Are You Committing a Crime?

Introduction:

Smoking and tobacco in Australia are heavily taxed as a measure taken to reduce its consumption. This strategy has been a success with a decline in the number of smokers in the country. However, with the high taxation came restrictions on importation and use of tobacco products, and violating these laws could result in heavy fines and even criminal prosecution.

I. Restrictions on Importation:

II. Criminal Offences:

According to the Customs Act 1901 (Cth), four different criminal offences relating to tobacco products have been identified. Section (1) prescribes a maximum penalty of 10 years in prison for intentionally defrauding the revenue by importing tobacco goods into the country through illegal means. Similarly, section (2) prescribes the same penalty on possessing or conveying tobacco products that were imported with the intention of defrauding the revenue. Subsection (2A) prescribes a maximum penalty of five years behind bars for importing tobacco products under circumstances of recklessness as to whether the revenue would be defrauded. Finally, subsection (2B) sets the same 5-year maximum penalty for the reckless possession or conveying of tobacco products.

III. Tobacco Products Definition:

According to the Customs Act further, tobacco products are defined to include cigars, cheroots, cigarillos and cigarettes of tobacco and tobacco substitutes, unmanufactured tobacco, and tobacco refuse. The definition also includes other manufactured tobacco and substitutes, extracts and essences, including waterpipe tobacco.

IV. The Black Market and Consequences:

The high taxes on tobacco have undeniably impacted the thriving black market culture in Australia, with many arranging for the importation of products by mail and others packing it into their luggage. While some may feel there’s little wrong with bringing a few extra packs into the country, the law says something completely different. Travellers who contravene the rules are at risk of having their visas cancelled, receiving infringement notices, or being criminally prosecuted.

Although taxation is often said to be for the people's benefit, it does not come without its consequences. Smoking and tobacco in Australia are heavily taxed, resulting in reduced consumption of tobacco products.
